Terms of Service
Fab Rent Homes is a venue and the software behind it. Each stay is a contract between you and the host's business. We hold deposits in neutral escrow, run independent arbitration, and charge a flat 2% fee.
Action needed: Draft
These terms are a pre-launch draft. Operator details and the governing jurisdiction must be finalized and reviewed before paid stays can open. No booking is available while these details contain placeholders.
1. Who we are, and who we aren't
These terms are an agreement between you and Fab Rent Homes ("Fab Rent Homes", "we", "us"). They cover your use of fab.rent and the services we run on it.
We operate a marketplace where independent hosts offer homes for stays of 30 nights or more. We are not a host, landlord, property manager, real estate broker, travel agent or insurer. We do not own, operate, inspect for code compliance, or control any home listed here.
When you book a stay, your contract for that stay is with the host's business named at checkout. We are not a party to it. The host's business is the seller of the stay and the merchant of record for its price.
2. Membership
You need an account to book or host. You must be at least 18 and able to enter a binding contract. Keep your email account secure: signing in is by a link sent to it.
Your Trust Passport summarizes your history here (completed stays, reviews, verification). It is yours to export and share. We may correct it if it is wrong, and we may suspend an account that misuses it.
3. Booking a stay
Stays are 30 nights or longer. At checkout you see the nightly rate, the number of nights, our fee and the total. You agree to these terms and to the host's house rules, as shown at that moment, when you book. Each booking keeps the version of the house rules you saw.
Payment is charged by the host's business through our payment processor. Your bank or card statement will name that business. Check-in and checkout times are in the home's local time zone.
A stay of 30 nights or more may give you rights as a tenant or occupant under the law where the home is. Nothing in these terms takes away rights that law gives you.
4. Our fee
We charge a flat network fee of 2% of the stay price, shown at checkout before you pay. The host's business pays its own payment processing costs. We don't add booking fees, service fees or currency markups on top.
If a stay is refunded, the cancellation policy on your booking says how much of the stay price and of our fee comes back to you.
5. Deposits and neutral escrow
A listing may ask for a damage deposit. The deposit, or an authorization for it, sits on the host's payment account, and only the platform's claim process can release or apply it. It is released after checkout unless the host opens a claim within the claim window.
"Neutral escrow" describes how we handle deposits: neither side can move the money alone, and every change is recorded. We are not a licensed escrow agent, and deposits are not held in a trust account in our name.
6. Cancellations and refunds
Each listing shows its cancellation policy before you book, and the policy on your booking is the one that applies. If a host cancels a confirmed stay, you get a full refund, including our fee.
Refunds are sent to your original payment method. The host's business funds the refund of the stay price; we refund our share of the fee.
7. Claims and independent arbitration
If a host believes a guest caused damage, the host may open a claim against the deposit within the claim window. The guest can respond with evidence. If you don't agree, the claim goes to an independent arbiter, whose decision on the deposit is final within the platform.
Arbitration here decides only what happens to the deposit. It does not stop either of you from going to court about anything else, and it is not a substitute for any legal process that applies to tenancies where the home is.
8. Honesty walkthroughs and listings
A verified walkthrough means a host recorded the home in person, at the address on the listing, and our checks matched the recording to that place. It is evidence that the home exists and looked like that when filmed. It is not an inspection, an appraisal, or a promise about safety, code compliance or condition on the day you arrive.
Hosts write their own listings and are responsible for them being accurate.
9. Your conduct
Don't use fab.rent to break the law, to discriminate against anyone, to harass anyone, to take payment off the platform for a stay found here, or to post things you don't have the right to post. Follow the house rules of any home you stay in.
We may remove content, cancel bookings that haven't started, or suspend accounts that break these terms. Where we can, we'll tell you why.
10. Content you share
You keep ownership of what you post: photos, walkthroughs, reviews and messages. You let us host, display and process it to run the service, and to show reviews and listings publicly as the product does.
11. Disclaimers
We provide the platform as it is. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted or error-free.
Hosts and guests are responsible for their own conduct, for homes and stays, and for complying with the law that applies to them.
12. Limits on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising from your use of fab.rent or any stay.
To the extent the law allows, our total liability to you for any claim about the service is limited to the greater of the fees you paid us in the 12 months before the claim, or $100.
Some places don't allow these limits, so they may not apply to you. Nothing here limits liability that can't be limited by law, including for our own fraud, gross negligence or wilful misconduct.
13. Indemnity
If someone brings a claim against us because of your breach of these terms, your stay or your listing, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
14. Disputes with us
These terms are governed by the laws of [STATE], without regard to its conflict-of-law rules, except where the law of the place you live or the home is located must apply.
Before filing a claim against us, contact us and give us 30 days to try to resolve it.
15. Changes
We may update these terms. When we do, we'll change the version date, and you'll be asked to agree again before your next booking. A booking already made stays under the version it was made under.
